Terms of Use
1. Agreement to these Terms
These Terms of Use (“Terms”) are an agreement between you and PhabPhysics, LLC, a New York limited liability company (“PhabPhysics,” “we,” “us,” or “our”). They govern your use of the Phab Physics website at phabphysics.com, including its practice problems, guided simulations, handouts, teacher dashboard and related services (together, the “Service”).
By using the Service, you agree to these Terms and acknowledge our Privacy Policy. If you create or use an account, the Account License Agreement also applies. If you do not agree, do not use the Service.
2. Who may use the Service
- Anyone may browse public pages, download public handouts and practice in guest mode.
- You must be at least 13 years old to create an account.
- If you are under 18 (or the age of majority where you live), you may use the Service only with the permission of a parent or guardian, or as directed by your school.
- Teacher accounts are for educators. Each teacher code is personal and activates one teacher account.
- If you use the Service on behalf of a school or other organization, you confirm that you are authorized to do so.
3. Schools and student data
Schools and teachers decide whether to use the Service with students. Teachers are responsible for obtaining any approval their school or district requires, including any required data-privacy agreement, before enrolling students.
When a school or district has signed a written agreement with us, such as a student data-privacy agreement, we handle student data on the school’s behalf as that agreement describes, and we use it only to provide the Service. If that agreement conflicts with these Terms, the agreement controls.
4. Accounts
- You sign in with a Google account. Keep your sign-in secure, and don’t let anyone else use your account.
- Provide accurate information, including the classroom name your teacher sees.
- You are responsible for activity on your account. Tell us promptly at alex@phabphysics.com if you believe someone has used it without permission.
- Join only classes you have been invited to join. Class codes and teacher codes may not be shared publicly, sold or transferred.
5. Our content and licenses
The Service, including its software, problem generators, simulations, design, text and the Phab Physics name and logo, is owned by PhabPhysics or its licensors. It is protected by copyright, trademark and other laws. Except as these Terms or a license allows, you may not copy, modify, distribute or create derivative works from it.
- Public student handouts marked with a Creative Commons license are available under that license (currently CC BY-NC-SA 4.0). That license governs those materials.
- Teacher-only materials, such as answer keys, unit tests, teacher guides and slides available only to verified teacher accounts, are not released under a Creative Commons license unless a file says so. They are licensed under the Account License Agreement.
- Hosted features such as accounts, practice tracking and the teacher dashboard are licensed, not sold, under the Account License Agreement.
- Open-source components used by the site remain subject to their own licenses.
6. Acceptable use
You agree not to:
- access or try to access another user’s account or data, non-public parts of the Service, or teacher-only materials you are not authorized to receive;
- post teacher-only materials (such as answer keys, unit tests and teacher guides) on a public website, sell them, or pass them to anyone not authorized to have them, for example by sharing a test or answer key with other students. This does not limit teachers giving tests, answer keys or solutions to their own students as part of instruction;
- use the Service to help anyone cheat;
- use bots, scrapers or other automated means to access the Service, harvest problems or answers, or submit work, except for accessibility tools you use yourself;
- interfere with or disrupt the Service, bypass its security, rate limits or abuse protection, or probe or test it for vulnerabilities without our written permission;
- reverse engineer or decompile the Service, except to the extent applicable law expressly permits;
- enter content that is unlawful, harassing, hateful, sexually explicit, or that impersonates someone else, including in classroom names or messages;
- use the Service or its content to build a competing product, or to train machine-learning or artificial-intelligence models, except as an open license on specific material permits; or
- use the Service in violation of any law or of your school’s policies.
If you believe you have found a security vulnerability, please report it to alex@phabphysics.com and do not access or change anyone else’s data.
7. Your content and feedback
You keep any rights you have in what you submit, such as answers, classroom names and messages. You give us a limited license to host, store, process and display that content only as needed to operate, secure and improve the Service. For example, we show your progress to your teacher. We handle personal information as our Privacy Policy and any applicable school agreement describe.
If you send us suggestions or feedback, we may use them without any obligation to you.
8. Teacher account fee and contributions
Students never pay. A new teacher account requires a one-time payment of at least $5. You choose the amount above that minimum; we suggest $3 per student. Pay through Ko-fi and ask for a teacher code in your message. If your school pays by invoice or purchase order, email alex@phabphysics.com instead. Teacher accounts activated before October 14, 2026 do not need this payment.
The payment:
- activates one teacher account for the 2026–2027 pilot year and does not promise access after that school year;
- does not activate an account automatically. We send each teacher code personally;
- is processed by Ko-fi and its payment providers under their terms. We do not receive your payment-card details;
- is not a tax-deductible charitable donation, because PhabPhysics, LLC is not a charity; and
- is non-refundable, except where the law requires a refund or we choose to give one.
You may also support the Service with an additional voluntary contribution. A voluntary contribution does not purchase any particular feature, level of service or period of access.
9. Third-party services
The Service relies on, or links to, services run by others. These include Google sign-in and Firebase, and Ko-fi. Your use of those services is governed by their own terms and privacy policies. We are not responsible for third-party services.
AP® and Advanced Placement® are registered trademarks of the College Board, which was not involved in producing, and does not endorse, Phab Physics.
10. Changes to the Service; pilot status
The 2026–2027 school year is a pilot year. We may change, suspend or discontinue all or part of the Service at any time. Pilot access does not promise access beyond the 2026–2027 school year. If we discontinue hosted classroom features, we will try to give teachers reasonable advance notice and a chance to export class progress, subject to any school agreement.
11. Suspension and termination
You may stop using the Service at any time, and you may ask us to delete your account as the Privacy Policy describes. We may suspend or end your access if you violate these Terms or the Account License Agreement, if needed to protect users or the Service, or if the law requires it. Where practical, we will give notice first. Sections 5, 7 and 12 through 17 survive termination.
12. Disclaimers
Practice problems, solutions, simulations, handouts and automatic scoring are provided for practice and instruction. They may contain errors. Teachers remain responsible for instructional and grading decisions. We do not guarantee any score or exam result.
TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. THIS INCLUDES IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE OR ERROR-FREE.
13. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, PHABPHYSICS AND ITS MEMBERS, EMPLOYEES AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, PROFITS OR GOODWILL, ARISING FROM OR RELATED TO THE SERVICE. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATED TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US, IF ANY, IN THE 12 MONTHS BEFORE THE CLAIM AROSE, OR (B) US $100.
Some jurisdictions do not allow certain limits, so some of them may not apply to you. Nothing in these Terms limits obligations we have under a signed school data-privacy agreement, or liability that cannot be limited by law.
14. Indemnification
To the extent permitted by law, you agree to defend and indemnify PhabPhysics against third-party claims, losses and reasonable costs arising from your misuse of the Service or your violation of these Terms. This section does not apply to a public school, school district or other governmental entity to the extent the law prohibits it from giving an indemnity.
15. Governing law and disputes
These Terms are governed by the laws of the State of New York, without regard to its conflict-of-law rules. Before starting a formal proceeding, please contact us so we can try to resolve the dispute informally within 30 days. Any proceeding must be brought in the state courts located in Livingston County, New York, or the federal courts for the Western District of New York. You and we consent to those courts’ jurisdiction. If you are a public school or governmental entity, this section applies only to the extent the laws that govern you permit.
16. Changes to these Terms
We may update these Terms. We will post the updated Terms here with a new date. For material changes, we will give reasonable advance notice on the site or by email to teacher accounts, plus any notice a signed school agreement requires. Changes take effect when posted unless the notice states a later date. Continuing to use the Service after changes take effect means you accept them.
17. General
These Terms, the Account License Agreement and the Privacy Policy are the entire agreement between you and us about the Service, except where you or your school has signed a separate written agreement with us. If there is a conflict, the order of priority is: (1) a signed written agreement with your school, including a data-privacy agreement; (2) the Account License Agreement; (3) these Terms.
If any provision is found unenforceable, the rest remain in effect. Our failure to enforce a provision is not a waiver. You may not transfer your rights under these Terms. We may transfer ours in connection with a merger, acquisition or sale of assets, subject to any school agreement.
