Account License Agreement
1. Acceptance
This Account License Agreement (“Agreement”) is between you and PhabPhysics, LLC (“PhabPhysics,” “we,” “us”). It applies when you create or use a Phab Physics account. You accept it by checking the agreement box when creating a teacher account, or by signing in to create or use an account after being shown a link to this Agreement.
This Agreement incorporates the Terms of Use. Terms defined there have the same meaning here. Our Privacy Policy explains how we handle personal information. If you are under 18, a parent, guardian or your school should review this Agreement with you.
2. Definitions
- “Account”: a student or teacher account created by signing in with Google.
- “Teacher Account”: an Account activated with a teacher code, which gives access to class management, student progress and Teacher Materials.
- “Materials”: practice problems, guided simulations, handouts and other instructional content made available through the Service.
- “Teacher Materials”: answer keys, unit tests, teacher guides, slides and other content available only to Teacher Accounts.
- “Student Data”: information about a student that the Service collects or stores, such as name, email address, class membership and practice records.
3. License grant
Subject to this Agreement, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license, for as long as your Account is active:
- Students: to access the Service, practice, track your progress, and take part in classes you have joined, for your own non-commercial educational use.
- Teachers: to use the Service for instruction. This includes creating and managing classes for students you teach, and viewing and exporting your students’ progress for instructional and grading purposes. You may display, project, print and distribute Materials to students in your classes. You may use Teacher Materials for your own instruction and assessment. That includes giving unit tests and other assessments to your students, and sharing answer keys or solutions with them when you choose to. You may also share Teacher Materials with other teachers at your school for the same purpose.
Public student handouts offered under a Creative Commons license remain available under that license, whether or not you have an Account.
4. Restrictions
Except as this Agreement or an applicable open license expressly allows, you may not:
- copy, modify, distribute, sell, rent, lease or sublicense the Service or Teacher Materials;
- post Teacher Materials on a public website or another publicly accessible location, or give them to anyone other than your own students (as part of instruction) and other teachers at your school;
- share your Account, or let anyone else use your teacher code or Teacher Account;
- circumvent sign-in, teacher-only access, or other access controls;
- use automated means to download, copy or extract Materials, answers or data from the Service;
- remove copyright, trademark or license notices;
- use the Service to provide a commercial service to others, such as a paid tutoring or test-preparation business, without our written permission; or
- use the Service in any way the Terms of Use prohibit.
5. Teacher responsibilities
If you have a Teacher Account, you agree to:
- obtain any approval your school or district requires, including any required student data-privacy agreement, before enrolling students;
- enroll only students you teach, and keep class codes within your classes;
- use Student Data only for instruction, and protect it in line with the Family Educational Rights and Privacy Act (FERPA), other applicable law, and your school’s policies;
- review automatically scored results before relying on them for grades;
- tell us promptly if you suspect unauthorized access to your Account or to Student Data; and
- follow your school’s direction about class records if you leave the school or close a class.
6. Student Data
Student Data belongs to the student or the school, as applicable law and any school agreement provide. We use it only to provide, secure and improve the Service, as the Privacy Policy describes. We do not sell Student Data, and we do not use it for advertising. When a school or district has signed a data-privacy agreement with us, that agreement governs Student Data for that school. If it conflicts with this Agreement, the school agreement controls.
7. Ownership
The Service and Materials are licensed, not sold. PhabPhysics and its licensors keep all rights not expressly granted in this Agreement. You keep any rights you have in content you submit, as described in the Terms of Use.
8. Fees
A new Teacher Account requires a one-time payment of at least $5, as described in the Terms of Use. Teacher Accounts activated before October 14, 2026 have no fee for the 2026–2027 pilot. If we introduce other fees, we will present separate terms. Paid features will not start without your agreement.
9. Term and termination
This Agreement starts when you first accept it. It continues until your Account is deleted or terminated. Pilot access does not promise access beyond the 2026–2027 school year.
You may stop using your Account at any time and request deletion as the Privacy Policy describes. We may suspend or terminate your Account or this license if you breach this Agreement or the Terms of Use, to protect users or the Service, or if the law requires it. When the license ends, you must stop using the Service and any Teacher Materials obtained through it. Records are handled under the Privacy Policy and any applicable school agreement. Sections 4, 6, 7, 9 and 10 survive termination.
10. Disclaimers, liability and general terms
The disclaimers, limitation of liability, indemnification, governing law, and general provisions in the Terms of Use (Sections 12 through 17) apply to this Agreement. If documents conflict, the order of priority is: (1) a signed written agreement with your school, including a data-privacy agreement; (2) this Agreement; (3) the Terms of Use.
We may update this Agreement as described in Section 16 of the Terms of Use. We will give Teacher Accounts reasonable advance notice of material changes.
